In Progress... Appeal packet was delivered in mail *after* scheduled hearing date

I filed an appeal regarding a denied unemployment claim last month on April 16, and was informed a hearing would be scheduled at a later date.

Last week, May 13, I received a mailed packet "Legal Mail" from the OAH with information about my hearing and the process. The problem is that the hearing had been scheduled for May 5, the week earlier. Of course I was not aware it had been scheduled, so I had not attended the hearing the previous week. I did not receive any email or other notifications that it had been scheduled before getting the mail.

The packet was postmarked as shipped on April 23 with "Quadient First-Class Mail IMI", so it should have been delivered within a week but it was not. I don't know if there is any tracking that would provide proof that it was not delivered in time.

Is there anything I can do about this? I guess I should have been checking the website every day, but I assumed I would get an email when the hearing was scheduled. I'd appreciate any advice, thank you.

Am mod, creator and here doing free customer service - Have templates for most circumstances - You'll need to file a specific motion for OAH (1 specifically and not any others). You have time to fix this and if we can connect and work together, you'll probably have a really good shot at getting the judge to approve your Motion

Call the OAH and explain what happened and ask to be rescheduled if possible.

Can't you check your online portal for the appeal status? You may have to appeal the appeal and wait even longer. But you have a good case especially if you have informed delivery and or some date mark on the envelope or letter. An AI could help with this too for advice. Also never assume anything with unemployment they go by the book (usually) and don't make it easy to contact someone for a quick resolution. They love their mail procedures.
