In Progress... Fired without reason and was denied benefits because I quit my last job to take the new one?

I'm confused and pissed. Have been waiting for over 3 months to get a determination and of course my benefitsa, and I was just denied. They said that I "quit my prior job (that I was at for about a year) due to personal reasons".

I quit my job because I was offered a new, better paying one, where I didn't have to work 60+ hours per week. I took that job, and was let go without being given a reason, afte 30 days. I never was late, missed any days, didn't even have a chance to perform as I was still in training. They just said they didn't think it was a fit.

Now all my benefit weeks I have filed all show as "denied". Is this right? Does leaving a job for a new one and getting fired without cause disqualify me for benefits? This doesn't seem right at all. Has anyone had this happen? What did you do?

After they denied me, I got a second email asking for more information about the company that fired me/reason for termination. I'm seeing this as a good sign? But I don't get it. I have already sent them a copy of my letter of resignation to the old company and my termination letter from the new company.

I have onbiously filed an appeal but would love any insight.

I'm on vacation right now so we have to schedule this. I offered to another person to do one of these custom free work projects (like I do here since 2021) at 8:00 p.m. or 10:00 a.m. tomorrow. They have not yet responded so it's open to you. Can you do 8:00 p.m. tonight? I'm Pacific time

Hi there this is a 15 to 45 minute conversation depending on the level of background information you've already read including the handbook or the website and material compiled here from those sources. I am currently on vacation, please tell me some times and dates that we can have this conversation and we can get this sorted out. Generally I have fixed this for people within a week or two It is really not that difficult for me as I have been here for 5 years doing this in this capacity in this way

Things we need to go over

  • Re-qualify Law

    • WAC 192-150, chapter
  • Current Job separation: Misconduct law

    • Appeal Process/ cancelling an appeal
  • Appeal Package or Initial eligibility statement

I have had two million of these conversations to the point where I know this entire conversation already before we've had it and everything that we're about to do has a template and a basis in publicly available information.

Dont get it if you quit, only under certain circumstances. Harassment, inability to perform to some extent, etc. Some employers won't contest if they like you. Most will. Raises their premiums.

But I quit the job to work for another job. The other job fired me after a month without cause. So shouldn’t determination be based on my last job? Not the one before it?

Did you report that to them? Had you been hired when you gave your notice? Did you start the new job within a reasonable amount of time? How was the second job better than the first?

Yes, I sent them my resignation letter and then my offer letter (started within 2 weeks of when I left previous job and offer letter was sent while I still worked there). I also sent them my termination letter from the new place showing that they offered no real reason, other than they decided they were moving in a different direction and I was still on my probationary period.

Second job was better because I was offered $30k more per year, health insurance, and a 40 hour work week. My prior job had no benefits and I was regularly working 60-70 hours per week without any additional pay. So, a no-brainer.

Based on my husband’s experience, it seems like UI is more apt to deny first and then if you protest your case will be looked at by a case manager (human being).

You should protest and tell them you found a different job because the first one had you working too many hours with small children. Cite the 60 hour work weeks and if little Timmy has a health issue make sure you include that as to why you left for another job. Better hours, schedule, health insurance, blah blah, blah.

Also if you have a health issue, a few doctor bills or EOBs will help justify it too.

Well yeah I have a special needs son and a young daughter. So I plan to fight it tooth & nail if I actually have to go to court. But it seems to me that something is off because you shouldn’t be penalized for getting a better job.

UI is clear, you quit you don’t get it unless there is a good reason. Sounds like you have some good reasons.

Years ago I helped someone in a similar situation and the demonstrated they were under a doctor’s care due to an on going chronic condition. Document it well and you should be fine.

I quit to start another job. I started at that job, was there for a month and then was fired without cause. So I’m not unemployed because of that job. I’m unemployed because of the following job. My understanding is that the decision is based off the job that rendered you unemployed. And now they are asking me for more information regarding the job that did so. So it seems weird they denied me, but are now asking questions. I don’t see why it would matter why I left my old job. That’s not the one that left me needing unemployment.

I understand that. I would throw everything and the kitchen sink at it, for the one you left and the one that termed with no cause. You had good reason to quit the first. They second, not your fault. They were flakey

Yeah, I mean I’m gonnafight it tooth and nail, was more so wondering if anyone had any insight on what’s going on because they are asking for more info after they denied me. So not even sure if the decision is final. Thanks for your input and advice!
