In Progress... Training Benefits Issue Question

I was approved for training benefits back in November 2024 and I have been satisfactorily progressing through the program. My graduation date changed due to course availability, pushed back from August 16 to October 18. This was properly reported to ESD by me and the college. When it was reported, ESD did a issue fact finding and asked for a modification for, indicating that the law allows one major change. This modification document was submitted right away, and it sat in adjudication for 13 weeks. Just a few days ago I got a letter stating that I no longer qualified because:

"We previously approved your Training Benefits (TB). Your training plan changed. You do not qualify for TB anymore because: • There are no funds for TB available at this time."

It then disqualified only the previous 13 weeks of my training benefits, going back to the issue fact finding date where the modification form was requested, and indicated I now owed an overpayment, which was declared to be my fault and that it cannot be waived (see attached image). The rest of the weeks going back to the original claim are fine. I cannot find any news on their site or the US DOL site about pulling training benefits funding. They also seem to still be accepting TB applications.

What do I do about this? Any help would be appreciated.

Yes. I would appreciate that so much. I was told to file the appeal but I dont know what to say or do and I can't be the only one they are doing this to.

I was on here last September thru November when I was first applying for the training benefits yes.

No I haven't read them yet. And yes I do understand the links, Training benefits just seems to be a not as common issue.

I have been working on this since we initially talked

I am not sure if you are aware so I'm going to relay things here that I don't mean to be rude or anything...

The document that announces the ineligibility specifically says that you have 30 days to file an appeal

I am offering you a huge amount of free work and I would appreciate it if you do not file the appeal because we have plenty of time in order to structure something very successful

I am currently working on a structure to help you appeal based on the laws listed and a separate law called the redetermination law which limits the amount of time in between when an eligibility issue is opened and when they can disqualify it. that is going to be a conversation that you and I are probably going to have on the phone at some point because otherwise it'll take like 30 replies and I honestly don't have the bandwidth to be doing that and it would take 10 times longer than a phone call

I expect to be available and doing that phone call with you probably sometime Thursday night after 6:30. would that work for you?

again I don't know if you're new here and I don't mean for that to sound like mean again... I don't know if you're aware that there's an entire process by which I formulate appeals, I do custom content creation for you and then the entire appeal package is reviewed by a law firm through which I have been referring people since 2021. it is with this law firm that I expect to be doing this professionally and paid for as an attaché. so we are not new to this.

I will also need to contact the law firm to see what their structure of this appeal would be and how they would represent you because the likelihood that you would need somebody to argue the redetermination law (my experience and supposition is correct and that that is what the correct argument would be, which I need to confirm with the law firm) is fairly high because it is very high context. The number of people who can generate the amount of confidence and confidence necessary to do a thorough evaluation in an appeal, or explain it to a judge, is about 10% or less of all the claimants that I interact with. we would know if you are in that 10% once we get an appeal structured and then I get a feeling of how confident or confident you are about the material. which will also be helped after your meeting with the law firm.

Thank you for all your time and energy. I know you do a lot for no pay and probably less appreciation. Please dont take my asking that question about the appeal as impatience. I just wanted to make sure I didnt misstep oh my end. With that said, I am not available tomorrow night. I have class.
