Rear-ended, herniated discs, $100k offer on $300k policy — would you take it?
Rear-ended in Brooklyn NY in 2025. MRI-confirmed herniated discs in neck and lower back. About a year of treatment. (Physio , some accupuncture ) Attorney says $100k settlement offer is strong. Policy limit is $300k. Attorney fee is 33%. I’m trying to understand whether this is generally considered a good offer or whether I’m anchoring too much on the gross settlement amount versus the net recovery. Curious what factors people would consider here.

I’d get a second opinion from a personal injury attorney. And in no way does that feel fair. What are the costs associated so far? Medical and vehicle repairs aside, still think of the life you may not live as easily in the future. How much will chiropractic sessions cost over the next ten years? How much time will you be in pain from walking? Or looking in a direction too fast? This could severely limit your mobility in the future so pay should reflect that. Also. Rear ended is usually the other person’s responsibility. Find someone that can fight for your best interests. And who is offering to 100k?
